These Terms of Service govern your use of nadeememailexpert.com and any services you engage me to provide. By using the site or engaging my services, you agree to these terms. If you don't agree, please don't use the site or hire me.
I've tried to keep this readable. Most of it is standard service-business language. If anything's unclear, ask me before signing up: hello@nadeememailexpert.com.
1. Who you're working with
Nadeem, an independent Klaviyo specialist operating as a sole proprietor based in Islamabad, Pakistan. Throughout this document, "I," "me," and "my" refer to Nadeem; "you" and "your" refer to the individual or business engaging my services or using the site.
2. Services I offer
I provide Klaviyo email marketing strategy, design, copywriting, and implementation services for direct-to-consumer supplement and wellness brands. My current productized services include:
- The $299 Audit, a 30-point Klaviyo account review, 25-page report, 90-day roadmap, 60-minute walkthrough call
- Foundation Build ($1,499), 4 core retention flows built in Klaviyo
- Full Retention System ($2,999), 8 flows, segmentation, integration setup
- Monthly Retainer ($1,999/mo), ongoing campaign management and optimization
Specific scope, deliverables, and timelines for any engagement will be confirmed in writing (via email or a signed proposal) before work begins. The proposal supersedes anything on the website if there's a conflict.
3. How payment works
Audit ($299)
Paid in full upfront via Wise. Work begins within 2 business days of payment. Delivery within 7 business days of receiving Klaviyo account access.
Foundation Build, Full Retention System (one-time projects)
50% deposit to start, 50% on delivery. Both payments via Wise or international wire transfer. Work begins within 5 business days of deposit.
Monthly Retainer
Billed monthly in advance via Wise. Minimum 3-month commitment. Either party can terminate after the minimum period with 30 days' written notice. No refunds for partial months once work has started for that month.
Late or failed payments
If payment fails or is more than 7 days late, I may pause work until it's resolved. Repeated late payments may end the engagement.
4. Refund policy
The honest version: If I haven't started the work yet, you get a full refund. If I've started, refunds depend on what's been delivered. If you're unhappy with the final deliverable, tell me, I'll usually rework it.
$299 Audit
Full refund if you cancel before I've started the audit (typically within 24 hours of payment). After I've started, no refunds because the work is substantially complete. If you receive the audit and feel it doesn't deliver what was promised, contact me within 14 days and I'll either rework specific findings or refund 50%.
One-time projects (Foundation, Full System)
Deposit is fully refundable for 7 days from payment or until work begins, whichever comes first. After work begins, the deposit covers initial discovery and strategy work and is non-refundable. If you cancel mid-project, you pay for work completed to that point (calculated as a percentage of the total deliverable).
Monthly Retainer
The 3-month minimum is binding once you've paid for month 1. After the minimum, monthly payments are non-refundable once the month begins, but you can cancel future months with 30 days' notice.
5. What you're responsible for
For me to do my best work, you need to:
- Provide timely access to your Klaviyo account, Shopify admin, Recharge dashboard, and any other tools needed
- Respond to emails or Slack messages requesting information or approvals within 3 business days
- Provide accurate brand assets (logos, product images, brand voice guidelines)
- Honor any compliance requirements specific to your brand (FDA/FTC for supplements, country-specific regulations)
- Pay invoices on time
If you delay responses or access more than 14 days, I may pause work and the timeline shifts accordingly. Significant or repeated delays may result in additional charges to cover lost time.
6. What I'm responsible for
- Delivering the scope we agreed on, on time
- Communicating clearly when something will be late, blocked, or has changed
- Building work that follows email marketing best practices and supplement industry compliance guidelines
- Treating any access you give me with the same care as my own accounts
I don't guarantee specific revenue results. I can show you what's worked for other brands, and I'll do honest work for yours, but email marketing outcomes depend on many factors outside my control (product quality, pricing, customer acquisition costs, competitive landscape, your team's execution after handoff).
7. Ownership of work
Anything I build or write specifically for your brand (custom flows, segments, email copy, designs) becomes yours once you've paid in full. You can keep using it, edit it, hand it off to another consultant, or take it with you.
I retain the right to use anonymized case studies, screenshots with sensitive data redacted, and general learnings from our work in my marketing, unless you explicitly ask me not to in writing.
Anything that exists before our engagement (my templates, frameworks, methodologies, the 30-point audit structure, this website) remains my intellectual property. The free templates downloadable from this site are licensed for your use under standard non-commercial-redistribution terms.
8. Confidentiality
I treat your customer data, revenue numbers, strategic plans, and proprietary information as confidential. I don't share specifics with other clients, post screenshots without permission, or discuss your numbers publicly without written approval. I'll sign an NDA if you need one before substantive conversations begin.
If you share information that's third-party-confidential (e.g. a vendor's pricing, a partner's customer data), make sure you have the right to share it with me.
9. Compliance with email marketing law
I build email programs that comply with major email marketing regulations (CAN-SPAM in the US, CASL in Canada, GDPR for EU subscribers, applicable supplement industry rules for the US: FDA structure-function language, FTC endorsement guides).
However, the ultimate responsibility for what your brand sends rests with you. You need to:
- Have proper consent from anyone on your list
- Honor unsubscribes promptly (handled automatically by Klaviyo, but you must not re-add people)
- Make claims you can back up with substantiation
- Comply with any country-specific rules where your customers reside
If something I draft is concerning from a compliance perspective, I'll flag it. But I'm not a lawyer, and the final review on any aggressive claims should go through your own legal counsel if you have one.
10. Limitations and disclaimers
No guarantee of results
Email marketing performance varies. Past results from other clients don't guarantee future results for you. The "typical impact" numbers shared in case studies, design examples, and copy examples on this site reflect realistic industry benchmarks and historical client outcomes, but they are not promises for any specific engagement.
Limitation of liability
To the maximum extent permitted by law, my total liability under any engagement is limited to the fees you've paid me in the 6 months preceding the claim. I'm not liable for indirect, consequential, or punitive damages, including lost profits, lost data, lost opportunities, or business interruption, even if I was advised such damages were possible.
Third-party tools
I don't control Klaviyo, Shopify, Recharge, or any other platform we use together. If a platform goes down, changes pricing, or breaks integration, that's outside my control. I'll help you navigate it, but I'm not liable for damages caused by third-party platforms.
11. Termination
Either of us can end an engagement at any time. Specifics:
- One-time projects: Either party can cancel before completion. You pay for work delivered to that point
- Monthly retainer: 30 days' written notice after the minimum 3-month period
- For cause (non-payment, material breach, unethical conduct): immediate termination by the non-breaching party
On termination, I'll provide a clean handoff: documentation of what was built, account access notes, and any in-progress work in its current state. Final invoice for any unbilled work is due within 14 days of termination.
12. Use of the website
You may use this website to:
- Read, share, and reference content I publish
- Download free resources for your own business use
- Contact me, book calls, or purchase services
You may not:
- Scrape the site, attempt to bypass any security measures, or use automated tools to extract content
- Resell or rebrand the free templates as your own product
- Misrepresent yourself or your business in form submissions
- Use the site for any unlawful purpose
13. Governing law
These terms are governed by the laws of Pakistan. Any disputes that can't be resolved through good-faith conversation will be resolved in courts located in Islamabad, Pakistan.
For clients based in the US, UK, EU, or elsewhere: this clause means we agree to resolve disputes under Pakistani law and jurisdiction. If that's a dealbreaker for your business, we can discuss alternative governing law in a written service agreement before engagement begins.
14. Changes to these terms
I may update these terms occasionally. The "Last updated" date at the top tells you when. For active clients, material changes take effect 30 days after I email you about them, or at the start of your next retainer month, whichever comes first. You can terminate without penalty within those 30 days if you don't agree.
